A residence card can be issued to a third country national family member accompanying or joining an EEA citizen.

The acting authority may grant permission to a person to stay as a family member who, in the country where they come from, was a dependent of an EEA citizen fulfilling the conditions for a stay exceeding three months, or lived in the same household with such an EEA citizen, or who is personally cared for by the EEA citizen due to serious health reasons.

A residence card can be issued to a third country national family member accompanying a Hungarian citizen or joining a Hungarian citizen.

The acting authority may grant permission to a person to stay as a family member who is a dependent of a Hungarian citizen, or who lives with him/her in the same household for at least a year, or who is personally cared for by a Hungarian citizen due to serious health reasons.

The acting authority can, at the initiative of the guardianship office, grant permission for a minor to stay as a family member and dependent of a Hungarian citizen, if he/she lives in the same household with him/her, was born in Hungary, his/her citizenship is unknown, and he/she does not have a parent who has legal custody of the child.
